Terms of Service
Effective date: 6 July 2026. These terms apply when you access or use FieldCard FSM on web, iOS, or Android. FieldCard FSM is operated by Sweet Phoenix Creations.
Using FieldCard FSM
FieldCard FSM is a business operations platform for field service teams. It includes tools for customers, quotes, invoices, payments, job cards, scheduling, inventory, field technician workflows, reports, messaging, and related services.
You must provide accurate account and business information, keep login details secure, and make sure your users only access information they are allowed to use.
You are responsible for the business data, prices, documents, customer information, tax details, payment settings, staff access, and messages entered into your account.
Accounts and access
Account owners and administrators are responsible for inviting users, assigning permissions, removing users who no longer need access, and controlling workspace access.
You may not use the service to break the law, infringe rights, distribute harmful content, attack systems, abuse messaging channels, or interfere with other users.
Documents, payments, and communications
Quotes, invoices, statements, job cards, payment links, and messages are generated from the information you enter. You must check documents before sending them to customers.
Payment processing is handled by third-party providers when connected. FieldCard FSM records payment status and references, but payment providers control card processing, settlement, disputes, and gateway rules.
Email, SMS, WhatsApp, and push notifications may depend on third-party providers, device permissions, network conditions, customer details, and your messaging configuration.
No professional tax, accounting, or legal advice
FieldCard FSM is software that assists with business administration. It is not an accounting firm, tax practitioner, legal adviser, financial adviser, auditor, or compliance officer.
Reports, totals, VAT/tax calculations, invoice wording, reminders, templates, and suggested workflows are generated from your settings and the data entered by your users. They are provided for operational assistance only and must not be treated as professional advice.
Before using FieldCard FSM outputs for VAT returns, income tax, payroll, statutory submissions, audited financial statements, customer contracts, or regulatory filings, you must review them with a suitably qualified accountant, tax practitioner, attorney, or other professional adviser.
Tax, VAT, records, and compliance
You are responsible for choosing the correct tax/VAT settings, deciding whether your business is VAT registered, entering accurate supplier and customer details, checking invoice numbers and dates, and keeping records required by law.
You are responsible for submitting returns, paying taxes, issuing lawful invoices, correcting errors, handling credit notes, and meeting any SARS, accounting, industry, licensing, safety, employment, consumer, or privacy requirements that apply to your business.
FieldCard FSM may help prepare and organise records, but it does not replace your own professional review or statutory obligations.
Subscriptions and fees
Some features may require a paid plan, usage limits, or third-party provider fees. Plan details, limits, prices, and included features may change as the service develops.
If payment is not received or an account is misused, access may be limited, suspended, or terminated where appropriate.
Availability and changes
We work to keep FieldCard FSM reliable, but we do not guarantee that the service will be uninterrupted, error-free, or available at all times.
We may improve, change, remove, or add features, integrations, layouts, workflows, and technical infrastructure over time.
Data and privacy
Your use of FieldCard FSM is also covered by our Privacy Policy. The policy explains what data is collected, how it is used, and how to contact us about privacy or deletion requests.
You must have the right to upload, store, process, and send the customer, staff, and business data you add to the service.
Liability
FieldCard FSM is provided as business software on an as-is and as-available basis. You remain responsible for professional judgement, regulatory compliance, tax treatment, customer agreements, safety, and the final accuracy of work and documents.
To the maximum extent allowed by law, FieldCard FSM and Sweet Phoenix Creations are not liable for indirect loss, lost profits, lost data, business interruption, tax penalties, assessments, rejected submissions, incorrect invoices, missed deadlines, customer disputes, or issues caused by third-party services, incorrect user data, network failures, device problems, unauthorised access, or misuse.
Nothing in these terms limits liability that cannot legally be limited, including liability for fraud, wilful misconduct, gross negligence where applicable, or rights that cannot be excluded under consumer, privacy, or other mandatory laws.
You agree to indemnify FieldCard FSM and Sweet Phoenix Creations against claims, penalties, losses, and costs arising from your data, your instructions, your customer communications, your tax or compliance decisions, your users, or your use of the service, except where the law does not allow this.
Termination
You may stop using the service and request account or data deletion. We may suspend or terminate access for non-payment, security risk, misuse, unlawful activity, or breach of these terms.
Changes to these terms
We may update these terms as the service changes. The latest version will be posted on this page.
